Common questions before starting

Am I legally required to register if I don’t earn the Minimum Wage (SMI)?

Yes. There is a lot of misinformation regarding this. Spanish jurisprudence indicates that the requirement for Social Security registration is the «habituality» of the activity, not the income. If you open an online store or provide periodic services, you must be registered. Working without registration carries real financial risks — and when an inspection arrives, there is no going back.

What is the Digital Certificate and why do I need it?

The Digital Certificate is your legal electronic signature in Spain. As a freelancer (autónomo), you are legally required to communicate electronically with the Public Administration. If you don’t have one, we explain how to get it, or we can act directly on your behalf with your official authorization.

Do I have to register a commercial premises if I work from home?

It is not necessary to declare a commercial location. You must declare the partial allocation of your primary residence (usually a room or home office). The Tax Agency allows you to allocate a legal maximum to deduct a small proportional part of utilities (electricity, internet). We calculate the correct percentage so you can deduct it without risk.

How long does the entire registration process take?

Once we have your DNI/NIE and the initial diagnostic is approved, the electronic submission is immediate. However, Social Security and the Tax Agency usually take between 24 and 48 business hours to cross-reference data and issue the final official registration resolution. We will always recommend the exact optimal day of the month to process it.

Can I issue invoices the exact same day I register?

Yes. From the moment we submit form 036 to the Tax Agency establishing your business start date, you are legally authorized to issue invoices and charge the corresponding VAT to your clients.

How much does it cost to register as an «autónomo»?

Registering with the Tax Agency and Social Security has no official government fee — neither for the setup nor for adding or modifying activities. What has a cost is doing it right.
